Donation Terms

1. Scope and Applicability

These Donation Terms ("Terms") govern all voluntary financial contributions ("Donations") made to the Embassy Row Project ("the Organization"), a philanthropic initiative founded by James Scott and headquartered in Washington, D.C. By making a Donation through any channel — including the Organization's website, affiliated platforms, or direct transfer — you acknowledge that you have read, understood, and agree to be bound by these Terms.

These Terms supplement the Organization's Terms of Service and Privacy Policy. In the event of a conflict between these Terms and the Terms of Service, these Donation Terms shall prevail with respect to donation-related matters.

2. Voluntary Nature of Donations

All Donations to the Embassy Row Project are entirely voluntary. No Donation is required to access the Organization's grant-funded services, submit applications, or engage with any publicly available content. The Organization does not condition access to its Services on the making of a Donation.

By making a Donation, you represent and warrant that: (a) you are at least 18 years of age or the age of legal majority in your jurisdiction; (b) you have the legal authority to make the Donation; (c) the funds used for the Donation are lawfully obtained; and (d) the Donation does not violate any applicable law, regulation, or third-party obligation.

3. Fund Allocation and Discretion

Unless a Donation is explicitly designated for a specific program or initiative and such designation is accepted in writing by the Organization, all Donations are treated as unrestricted contributions. The Organization retains sole and absolute discretion over the allocation of donated funds, which may be directed toward:

  • Scholarship and grant programs for qualifying organizations and communities
  • Research, development, and operation of the Organization's 63+ specialized institutes and platforms
  • Field operations across Southeast Asia and other program regions
  • Administrative, operational, and infrastructure costs necessary to sustain the Organization's mission
  • Technology development, cybersecurity infrastructure, and platform maintenance
  • Strategic reserves to ensure long-term organizational sustainability

The Organization is not obligated to use Donations for any specific purpose unless a restricted gift agreement has been executed. For details on how the Organization allocates funds, please refer to the Fund Usage Policy.

4. Refund Policy

Donations are generally non-refundable. Once a Donation has been processed, the Organization is under no obligation to return the contributed funds. Exceptions may be considered at the Organization's sole discretion in the following circumstances:

  • Demonstrable processing errors resulting in an incorrect Donation amount (e.g., duplicate charges, decimal errors)
  • Unauthorized transactions where the donor provides evidence that the Donation was made without their consent
  • Situations where applicable law requires a refund

Refund requests must be submitted within thirty (30) days of the Donation date through the Organization's contact page. The Organization will review each request on a case-by-case basis and respond within fifteen (15) business days. Approved refunds will be processed to the original payment method within thirty (30) business days.

5. Payment Processing and Third-Party Services

Donations are processed through third-party payment processors. The Organization does not directly collect, store, or process credit card numbers, bank account details, or other financial account information. All payment data is handled by the payment processor in accordance with the Payment Card Industry Data Security Standard (PCI DSS).

By making a Donation, you agree to the terms and conditions of the applicable payment processor. The Organization is not responsible for errors, delays, or failures caused by the payment processor, your financial institution, or network connectivity issues. Transaction fees charged by payment processors are borne by the Organization unless otherwise disclosed at the time of the Donation.

6. Tax Considerations

The tax deductibility of your Donation depends on your jurisdiction and personal tax circumstances. The Organization does not provide tax advice and makes no representations regarding the tax treatment of any Donation. Donors are solely responsible for determining the tax implications of their contributions and should consult a qualified tax professional.

Upon request, the Organization will provide donation receipts that include the date, amount, and purpose of the Donation. These receipts are provided for record-keeping purposes only and do not constitute a determination of tax deductibility.

7. Donor Data and Privacy

The Organization collects and processes donor information — including name, email address, Donation amount, and transaction identifiers — in accordance with the Privacy Policy. Donor information is used exclusively for:

  • Processing and acknowledging the Donation
  • Issuing donation receipts upon request
  • Communicating with donors regarding the Organization's mission and impact (with opt-out available)
  • Complying with applicable legal and regulatory requirements
  • Internal record-keeping and financial reporting

The Organization does not sell, rent, or commercially share donor information with third parties. Donors may exercise their data rights — including access, correction, deletion, and portability — as described in the Privacy Policy.

8. Anti-Fraud and Verification

The Organization reserves the right to verify the identity of donors and the legitimacy of Donations. The Organization may decline, return, or reverse any Donation that it reasonably believes to be fraudulent, made with stolen payment credentials, in violation of applicable law, or associated with money laundering, terrorist financing, or other illicit activity. The Organization cooperates with law enforcement authorities in the investigation of suspected fraudulent Donations.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE ORGANIZATION SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH ANY DONATION, INCLUDING BUT NOT LIMITED TO LOSSES RESULTING FROM PAYMENT PROCESSING ERRORS, UNAUTHORIZED TRANSACTIONS, OR THE ORGANIZATION'S ALLOCATION OF DONATED FUNDS. THE ORGANIZATION'S TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT OF THE DONATION AT ISSUE.

10. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the District of Columbia, United States of America, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms shall be resolved through binding arbitration administered in Washington, D.C. in accordance with the rules of the American Arbitration Association.

11. Modifications

The Organization reserves the right to modify these Terms at any time. Material changes will be posted on this page with an updated effective date. Modifications do not apply retroactively to Donations made before the effective date of the change. Your continued making of Donations following any modification constitutes your acceptance of the revised Terms.
