These outputs:

The Organization operates grant-funded programs that provide services at no cost to qualifying organizations. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE ORGANIZATION DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND COMPLETENESS. THE ORGANIZATION DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR FREE FROM ERRORS, VIRUSES, OR OTHER HARMFUL COMPONENTS.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE EMBASSY ROW PROJECT, JAMES SCOTT, AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, AND SUCCESSORS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH:

  • •Your access to, use of, or inability to use the Services
  • •Any reliance on content, analytical outputs, or intelligence products provided through the Services
  • •Decisions made or actions taken based on information obtained through the Services

Because all services are provided at no cost through grant funding, the total aggregate liability of the Organization for any claims arising under this Disclaimer shall not exceed one hundred United States dollars (USD $100.00). This limitation applies regardless of the legal theory upon which the claim is based, including contract, tort, negligence, strict liability, or any other basis.

9. Indemnification

You agree to indemnify, defend, and hold harmless the Embassy Row Project, James Scott, and their respective officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees and court costs) arising out of or in any way connected with your access to or use of the Services, your reliance on any content or analytical output, your violation of this Disclaimer or any applicable law, or your infringement of any intellectual property or other right of any third party.

10. Governing Law and Jurisdiction

This Disclaimer shall be governed by and construed in accordance with the laws of the District of Columbia, United States of America, without regard to its conflict of law provisions.

Any dispute arising out of or relating to this Disclaimer shall first be submitted to good-faith mediation. If mediation is unsuccessful within thirty (30) days, the dispute shall be resolved by binding arbitration administered in Washington, D.C. in accordance with the rules of the American Arbitration Association. Each party shall bear its own costs unless the arbitrator determines otherwise. Nothing in this section prevents either party from seeking injunctive or equitable relief in a court of competent jurisdiction to prevent irreparable harm.

11. Modifications

The Organization reserves the right to modify this Disclaimer at any time. Material changes will be posted on this page with an updated effective date. Your continued use of the Services following any modification constitutes your acceptance of the revised Disclaimer. The Organization encourages you to review this page periodically.
